N.D.C.C. § 32-03-09.1.
Section 32-03-09.1, N.D.C.C., states:
When a property is not related to a contract, its damages are usually measured by the reasonable repair cost needed to bring the property back to its condition before the damage took place. The reasonable value of not being able to use it during repairs is also charged. However, if the repairs are impossible in a fixed time frame, the damages are measured by the difference between the property’s market price immediately before and after its is damaged. In this situation, too, the reasonable cost of not being able to use it until the replacement of the property is charged.
Property restoration is considered worthless when the repair costs plus the value of not using the property during repair exceed the market value of your property plus the value of not being able to use it while waiting for a replacement.
